These Terms & Conditions (“Agreement”) are entered into between Global Transportation LLC (“Global Transportation” or “we”) and you (either an individual or a legal entity) (“Client” or “you”) and govern your use of our transportation reservation services (the Transportation Services”).
By accessing, browsing, or using our website, making a reservation, or otherwise indicating your acceptance of this Agreement, you represent and warrant that (a) you are authorized to enter into this Agreement on behalf of yourself and any organization you represent, (b) you and your organization can legally enter into these terms, and (c) you have read, understood, and agree to be bound by the terms of this Agreement.
1. Reservations and Deposits
Reservations for transportation services may be made through our website (the “www.globaltransportation.org”) or by phone. Until a reservation is confirmed in writing by Global Transportation, it is subject to change by us or you.
You understand and agree that all payments for reserved services shall be made payable to and collected by Global Transportation LLC. We are not responsible for lost or undelivered reservation confirmations due to spam filters or internet issues.
All reservations made more than fourteen (14) days from the scheduled service date require a deposit of at least twenty (20) percent, with full payment due within 14 days of reservation. Reservation changes are subject to availability and may incur additional fees determined by Global Transportation.
2. Cancellations and Refunds
(a) Regarding the cancellations: 30 days cancellation on all buses/ 14 days on sprinters / 14 days on group reservations / 72 hrs on as direct suvs and sedans/ 4 hrs on suv and sedan transfers.
(b) To cancel a reservation, a written notice must be sent to support@globaltransportation.org.
(c) You agree to pay any cancellation or change fees incurred. Such charges are final and not transferable.
(d) If the client is not present at the scheduled pick-up location and cannot be reached within 60 minutes of the scheduled time, the reservation is considered a no-show, and the client is fully liable for 100% of the Estimated Cost.
3. Rates and Payment
(a) Advertised rates are subject to change without notice and may increase prior to confirmation by Global Transportation.
(b) Quoted rates are estimates based on provided information. Additional charges may apply for taxes, credit card fees, damages, overtime, extended travel, and excessive cleaning.
(c) By making a reservation, you authorize Global Transportation to charge your provided payment method and make necessary adjustments. Declined card payments may result in termination of card payment options.
(d) Refusal to pay by check or wire transfer for amounts exceeding $5,000 does not nullify this agreement and may result in reservation cancellation and applicable charges.
4. Overtime and Additional Charges
(a) Clients are responsible for overtime charges incurred, billed in hourly increments.
(b) Additional expenses such as driver lodging, tolls, parking fees, extra stops, and other incurred costs are the client’s responsibility.
(c) Clients failing to provide driver lodging meeting specified standards agree to reimburse Global Transportation for alternative lodging costs.
5. Transportation Services
(a) Images and information on the Website may differ from actual vehicles.
(b) Global Transportation does not guarantee specific vehicle make, model, appearance, amenities, or driver behavior.
(c) Clients waive claims related to service delays caused by Force Majeure events or vehicle conditions.
(d) SPAB, DOD certification, or special permit requests are not guaranteed unless agreed upon in writing at reservation time.
6. Warranties; Disclaimers; Limitations of Liability
(a) Each party warrants the ability to enter this Agreement.
(b) Global Transportation disclaims all warranties, express or implied, regarding services provided.
(c) Global Transportation’s liability is limited to the amount paid by the client within the past twelve (12) months or $5,000, whichever is greater.
7. License
(a) Clients grant Global Transportation a license to use event-related trademarks for promotional purposes.
8. Indemnification
Clients agree to indemnify and hold harmless Global Transportation from third-party claims arising from a breach of this Agreement.
9. Governing Law and Dispute Resolution
(a) This Agreement is governed by Georgia law. Parties waive trial by jury.
(b) Disputes are resolved through binding arbitration in Fulton County, Georgia, unless excluded by agreement.
10. Non-Disparagement
Clients agree not to take action that harms Global Transportation’s reputation. Violation may result in legal action and fee recovery.
11. Miscellaneous
(a) Severability: Illegal provisions are severed; the remainder of the Agreement remains in effect.
(b) Waiver: Waiver of a breach does not waive subsequent breaches.
(c) Notices: Written notices are delivered personally, by courier, or electronically.
(d) Rights and Remedies: Rights and remedies are cumulative.
(e) Entire Agreement: This Agreement constitutes the entire understanding between the parties.
(f) Assignment: This Agreement may not be transferred by the client without consent.
(g) No Agency: No agency relationship is created by this Agreement.
(h) Survival: Certain provisions survive termination.
